What is IP risk evaluation?

If you’re a brand or technology-led business, IP risks are there – whether you know about them or not.  We can help you to identify and understand the IP risks that you face, how the risk can be quantified, and what your options are to mitigate that risk.

One way to identify IP risk is to perform a freedom to operate search. However, undertaking a full freedom to operate search in every territory in the world is impractical for most companies.  The good news is there are other options you can consider that will reveal the most critical IP risks.

We can advise you on the best approach for evaluating IP risk, and, if that involves a freedom to operate search, we’ll help you define the parameters.

Patent Risk Evaluation

When it comes to patent risk evaluation, things get complicated.  The sheer number of patents that exist means that identifying those that are relevant to your business can be both time-consuming and expensive.  It is further complicated by pending patents and the fact that patent rights may differ from country to country.

A good place to start is by evaluating the IP risk around you and identifying the patent rights that are most likely to cause you a problem and hold your business back.  Once high-risk patents have been identified, we can then suggest risk mitigation options.  You might consider design-arounds to try and identity product changes, or look at patent validity, which involves attacking the patent so that it’s knocked out or narrowed in scope to clear a path for you.
