Paediatric extensions now available in Norway

SPCs filed in Norway that have an expiry date later than 1 March 2017 can now be extended by a further six months, provided that the conditions of Regulation (EC) No 1901/2006 and transitional regulations are met.  Applications for paediatric extensions can be submitted from 1 August 2017. Of note is that the usual cut-off date for requesting a paediatric extension is 2 years prior to SPC expiry, however during the transitional period, ending 1 September 2022, applications for a paediatric extension can be submitted right up to 6 months prior to SPC expiry.   Now is a good time for innovators to review their patent portfolio for Norwegian SPCs expiring after 1 March 2017 and check whether paediatric extensions should be requested.
