UK ratifies Unified Patent Court Agreement on World IP day

On 26 April 2018 the UK Government ratified the Unified Patent Court (UPC) Agreement. This means the only country that still needs to ratify the Agreement before it can come into effect is Germany. The German ratification is delayed pending a decision by the German constitutional court in relation to Germany’s participation in the Agreement.

The UPC Agreement is an international treaty establishing a court having jurisdiction across each of the member states that have ratified the Agreement, all of which are EU member states. The UPC goes hand in hand with the Unitary Patent that will be established at the same time as the UPC. This is intended to provide a single unitary patent right in the member states that have ratified, and will be available through the European Patent Office.
